1. Agreement and operator
These Terms govern flavourbites.us and related U.S.-facing online services operated for flavourBites Inc. (“Flavour Bites”, “we”, “us” or “our”). By using the site, following a purchase link, or submitting an inquiry, you agree to these Terms to the extent permitted by applicable law.
Flavour Bites is a Canadian business making certain products available to U.S. customers through authorized retail, ordering and fulfillment arrangements.
2. Website information and availability
We try to keep product descriptions, prices, availability, photographs and other content accurate, but they may change without notice. Images are illustrative and actual packaging, colour, texture or presentation may vary.
If website information conflicts with final packaging or information presented by the retailer at checkout, rely on the final package and point-of-purchase information, subject to applicable law.
3. Purchases through One Stop Halal and other third parties
Product purchase links may take you to One Stop Halal or another independent third-party retailer or checkout platform. Once you leave flavourbites.us, the retailer’s checkout, payment, shipping, refund, privacy and other terms may apply in addition to these Terms.
Flavour Bites does not collect full payment-card numbers on flavourbites.us when payment is processed by the retailer or its payment provider. Product availability, shipping eligibility, taxes, fees, payment authorization and final purchase acceptance are determined at checkout.
4. Food allergies and dietary restrictions
Always review the current physical package before consuming a product. Ingredients and suppliers may change. Customers with allergies, celiac disease, intolerances, medical conditions or dietary restrictions should not rely solely on website copy.
5. Packaged products, food safety and claims
The legally required physical label is the authoritative source for ingredients, allergen declarations, Nutrition Facts, net quantity, storage and regulated product information. Do not use products with damaged, tampered, expired or improperly stored packaging.
Product descriptions are not medical advice. Statements about ingredients, lifestyle, comfort, flavour or preparation are not intended to diagnose, treat, cure or prevent disease. Any regulated health or nutrient claim should be interpreted only as permitted by applicable law and supported by the final product labeling.
6. Pricing, shipping, cancellations and refunds
Unless stated otherwise, prices presented for U.S. sales are in U.S. dollars. Taxes, shipping and fees are determined at checkout. The retailer or fulfillment partner handling the transaction may maintain its own cancellation, return, refund and shipping policies.
Nothing in these Terms limits any non-waivable federal or state consumer right or statutory remedy.
7. Franchise and development information
No franchise will be offered or sold except in compliance with applicable federal and state franchise laws and required disclosure obligations. No website statement is a promise, projection or representation of sales, profit, return on investment, payback period or financial performance.
8. Intellectual property
Flavour Bites names, logos, packaging, trade dress, product names, photographs, videos, text, graphics and other content are owned by or licensed to us and protected by applicable intellectual-property laws. You receive only a limited right to access the website for personal, non-commercial use.
You may not copy, scrape, reproduce, modify, publish, sell, frame, exploit or use our branding or content to create a competing commercial offering without prior written permission.
9. Acceptable use
You must not interfere with website operation, attempt unauthorized access, introduce malicious code, harvest data, impersonate others, submit fraudulent information, violate third-party rights or use the site for unlawful, abusive or deceptive activity.
10. Third-party links and services
Links to retailers, fulfillment providers, payment services, maps, social platforms and other third parties are provided for convenience. We do not control independent third-party services and are not responsible for their availability, security, content or privacy practices except where responsibility cannot legally be excluded.
11. Disclaimer of warranties
To the maximum extent permitted by law, the website and content are provided “as is” and “as available”. We do not guarantee uninterrupted, error-free or completely secure operation or compatibility with every device.
12. Limitation of liability
To the maximum extent permitted by applicable law, Flavour Bites and its directors, officers, employees, affiliates and service providers are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, loss of profits, data, opportunity or business interruption arising from use of the website or independent third-party services.
Nothing excludes liability or rights that federal or state law does not permit to be waived or limited, including applicable consumer, privacy or product-safety rights.
13. Indemnity
To the extent permitted by law, you are responsible for losses, claims, liabilities and reasonable costs arising from your unlawful misuse of the website, fraud, violation of these Terms or infringement of another person’s rights.
14. Privacy
Our handling of personal information is described in our Privacy Policy.
15. Changes
We may update these Terms as our services, technology or legal obligations change. The effective date above identifies the current version. Changes apply prospectively unless applicable law requires otherwise.
16. Governing law and mandatory rights
Except where a mandatory U.S. federal or state law requires otherwise, these Terms are governed by the laws of Alberta and applicable federal laws of Canada, without regard to conflict-of-law rules. Nothing in this clause deprives a U.S. consumer of rights or remedies that cannot lawfully be waived by contract.
17. General
If a provision is unenforceable, the remaining provisions continue in effect. Failure to enforce a provision is not a waiver. These Terms do not create an employment, agency, partnership, joint venture or franchise relationship.
